These Terms of Sale apply to all purchases made through magnuspens.com (the "Store"). By placing an order, you agree to these terms.

2. Orders & Acceptance

• Your order is an offer to purchase. A contract is formed only when we send you an order confirmation email and payment has been successfully processed.
• We may decline or cancel an order at our discretion — for example, where a product is unavailable, a pricing or listing error has occurred, or we suspect fraud. If we cancel an order after payment, you will receive a full refund.
• For limited-edition releases, orders exceeding any stated per-customer purchase limit may be reduced or cancelled.

3. Pricing, Currency & Payment

• All prices are displayed in USD and, unless stated otherwise, exclude any import duties or taxes payable in your country (see Section 5).
• Prices for orders shipped within New Zealand include GST where applicable.
• Payment is processed at checkout via the payment methods shown on the Store. We do not store your full payment card details.
• We take care to price accurately, but if a product is listed at an obviously incorrect price due to error, we may cancel the order and refund you in full.

4. Shipping & Delivery

• We ship from New Zealand. Estimated dispatch and delivery timeframes are shown at checkout and are estimates only, not guarantees.
• Risk in the goods passes to you on delivery to your address. Title passes on the later of delivery or receipt of full payment.
• If a parcel is returned to us as undeliverable due to an incorrect address you supplied or failure to collect, we may deduct re-shipping costs or, for refunds, the original outbound shipping cost.

5. International Orders — Duties & Taxes

• Orders shipped outside New Zealand may be subject to import duties, tariffs, customs fees, and local taxes levied by the destination country. These charges are your responsibility and are not included in our prices or shipping charges unless expressly stated at checkout.
• If you refuse a shipment because of these charges, any costs of return or destruction and the original shipping cost may be deducted from your refund.

6. Returns & Refunds

7. Product Descriptions & Materials

• We take care to describe and photograph our products accurately. However, materials such as titanium, timascus, and natural finishes vary piece to piece — colour, pattern, and grain in the product you receive may differ from photographs. This variation is a characteristic of the materials, not a defect.
• Minor machining marks consistent with a precision-manufactured product are not defects.

8. Warranty & Consumer Guarantees

• Our goods come with guarantees that cannot be excluded under the New Zealand Consumer Guarantees Act 1993 ("CGA"). You are entitled to a replacement or refund for a major failure and to compensation for other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality.
• If you are purchasing from outside New Zealand, you may have additional rights under the consumer protection laws of your country, and nothing in these terms limits those rights.

9. Limitation of Liability

To the maximum extent permitted by law, and except for liability that cannot be excluded (including under the CGA for consumer purchases):

• Our total liability arising from any order is limited to the amount you paid for that order.
• We are not liable for indirect or consequential loss, loss of profit, or loss of data.
• If you are acquiring goods for business purposes, you agree that the CGA does not apply to that purchase.

10. Intellectual Property

All content on the Store — including product designs, photography, text, and branding — is the property of Magnus Pens or its licensors and may not be reproduced without our written permission.

11. Privacy

Personal information collected through the Store is handled in accordance with our Privacy Policy and the New Zealand Privacy Act 2020.

12. Changes to These Terms

We may update these Terms of Sale from time to time. The version in effect at the time you place your order applies to that order.

13. Governing Law

These Terms of Sale are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the New Zealand courts. If you are a consumer, this does not deprive you of the protection of mandatory consumer laws in your country of residence.
